City of Alamogordo, New Mexico

If you are cited for a DWI Offense, you will be given an arraignment date either by the officer, court, or bail bondsman.  This is a MANDATORY court appearance.  Arraignments are held Mondays, Tuesdays, Thursdays at 9:00a.m. or Wednesdays at 5:00p.m. 

If you plea NOT GUILTY, you will be given a Pretrial hearing date to allow time to seek an attorney or apply for a public defender through Municipal Court.  You will need to complete an Indigent Application.  You will also be given a Trial hearing date set for a Wednesday at 9:30a.m. 

If you plea NO CONTEST or GUILTY, you will be required to sign a Waiver of Right to Counsel, giving up your right to a Trial and an Attorney.  You then will be ordered to undergo an Alcohol/Substance Abuse Screening with Municipal Court.  Screenings are held Mondays, Tuesdays, Thursdays from 1:30p.m.-4:00p.m.  The cost for a screening is $100.  A Sentencing date will be set for a Tuesday or Thursday at 8:00a.m.

Upon a DWI conviction in Municipal Court, you will face the following actions:

1st DWI Simple (Alcohol level .15 or less)
Misdemeanor
Up to 90 days in jail
1 year probation
$500 Fine
$189 Fees
Mandatory:  DWI School ($150), Alcohol/Substance Abuse Screening ($100), 24 hours community service, NEEDS Survey ($32), Counseling, Ignition Interlock, report monthly to court.

1st DWI Aggravated (Alcohol level .16 or greater/refusal)
Misdemeanor
Up to 90 days of jail 
Mandatory 48 hours of jail or 4 days on Electronic Monitor at client's expense
1 year probation
48 hours community service
Same conditions as 1st DWI Simple

2nd DWI Simple (Alcohol level .15 or less) 
Misdemeanor
2 year license revocation
Up to 179 days jail
Mandatory 96 hours of jail or 30 days on Electronic Monitor at client's expense
1 year probation
$500 - $999 Fine
$189 Fees
Mandatory:  Alcohol/Substance Abuse Screening ($100), 48 hours community service, NEEDS Survey ($32), minimum 90 days outpatient counseling, Ignition Interlock, report monthly to court.

2nd DWI Aggravated (Alcohol level .16 or greater/refusal)
Misdemeanor
Up to 179 days jail
Mandatory 144 hours of jail or 30 days on Electronic Monitor at clients' expense
1 year probation
$500 - $999 Fine
$189 Fees
Same conditions as 2nd DWI Simple



COUNCELING/TREATMENT OPTIONS

If you are sentenced to complete some type of Counseling or Treatment, you will be asked to choose from one of the following locations:

Flex schedule available.  Must attend at least one class per week. Saturdays by scheduled appointment only.	Groups meet Wednesdays 5:30pm, Thursdays 5:30pm, Fridays at 10:30am Womens - 10am Wednesdays Flex schedule available.  Must attend at least one class per week.  Individual sessions can be substituted to meet outpatient requirements. Saturdays by scheduled appointment only.	Course is open dependent on clients schedule.  Flex schedule available Parenting Class - 6 week course Anger Management - 6 week course Saturday by scheduled appointment only.	Appointments Monday to Friday - 8:00am to 6:00pm. Saturaday by appointment only.	Rates are available on ability to pay. Most Insurance accepted. Call for details.  Payment plans accepted. *Free Counseling Services to those who qualify!  ATR Provider Senior Citizen Rates.
The Counseling Center 1900 E. 10th Street 437-7404 Spanish Speaking Available	Hours are met by individual sessions or through group sessions. No weekends available, only Monday to Friday.	Day and evening groups available Monday through Friday and must attend 3 times a week.	Parenting available.  Roster must be full before classes start.  Anger Management: Men: Mondays 5pm-6:30pm x 12wks Women’s: Thurrsdays 4:00 to 5:00 pm x 12wks	Hours are available Mondays to Fridays 8-5.	Most Isurance accepted.  Co-pays required.  If no insurance, depending on income.  Medicaid accepted.
Alamogordo Counseling Associates 1200 White Sands Suite 111 443-6166	Hours are met by individual sessions.	Hours are met by individual sessions.	Hours are met by individual sessions for anger management. No parenting available at this time.	Appointments day and evenings Monday to Friday.	Rates are available on ability to pay. Typical counseling sessions starts at $30.00.  Most Insurance accepted.  Call for details.  Payment plans accepted.
