Driving While Intoxicated (DWI) Violation
Court Appearances for DWIs
If you are cited for a Driving While Intoxicated (DWI) Offense, you will be given an arraignment date either by the officer, court, or bail bondsman. This is a mandatory court appearance. Arraignments are held Mondays, Tuesdays, and Thursdays at 9:00 a.m..
Not Guilty Plea
If you plea Not Guilty, you will be given a Pre-Trial hearing date to allow time to seek an attorney or apply for a court appointed attorney through Municipal Court. You will need to complete an Indigent Attorney Application (PDF). You will also be given a Trial hearing date set for a Wednesday.
Guilty or No Contest Plea
If you plea No Contest or Guilty, you will be required to sign a Waiver of Right to Counsel, giving up your right to a Trial and an Attorney. You then will be ordered to undergo an Alcohol/Substance Abuse Screening with Municipal Court. The cost for a screening is $100. A Sentencing date will be set at 8 a.m.
Actions following a DWI conviction depend on the level and number of offenses.
1st DWI Simple (Alcohol Level 0.15 or Less)
- Misdemeanor
- Up to 90 days in jail
- 1 year probation
- $500 Fine
- $199 Fees
- Mandatory: DWI School ($175), Alcohol/Substance Abuse Screening ($100), 24 hours community service, IDA Survey ($40), Counseling, Ignition Interlock, report monthly to court
1st DWI Aggravated (Alcohol Level 0.16 or Greater / Refusal)
- Misdemeanor
- Up to 90 days of jail
- Mandatory 48 hours of jail or 4 days on Electronic Monitor at client's expense
- 1 year probation
- 48 hours community service
- Same conditions as 1st DWI Simple
2nd DWI Simple (Alcohol Level 0.15 or Less)
- Misdemeanor
- 2 year license revocation
- Up to 179 days jail
- Mandatory 96 hours of jail or 30 days on Electronic Monitor at client's expense
- 1 year probation
- $500 to $999 Fine
- $199 Fees
- Mandatory: Alcohol/Substance Abuse Screening ($100), 48 hours community service, IDA Survey ($40), minimum 90 days outpatient counseling, Ignition Interlock, report monthly to court
2nd DWI Aggravated (Alcohol Level 0.16 or Greater / Refusal)
- Misdemeanor
- Up to 179 days jail
- Mandatory 144 hours of jail or 30 days on Electronic Monitor at clients' expense
- 1 year probation
- $500 to $999 Fine
- $199 Fees
- Same conditions as 2nd DWI Simple
