Q: Can Code Enforcement tell my neighbor to cut their tree limbs that are hanging over onto my property?
A: No. That would be a civil matter between you and your neighbor.
Q: Can I get more time than what is stated in the Notice of Violation letter to take care of the violation?
A: In most cases, yes. You will need to speak with the Code Officer who sent you the letter. They can be contacted at the phone number listed on the letter. If you show progress in complying, the Code Officer should work with you.
Q: I have a tenant living in a property that I own. Can I get a fine for their violation of an ordinance?
A: Citations for noncompliance may be issued to the owner/renter/lessee. If the City has to bring the property into compliance, the bill for same will be the responsibility of the owner of record and the Otero County Assessor’s Office.
Q: I received a notice about rubbish and trash, but I didn’t put it there. Am I still responsible?
A: Yes. A property owner is responsible for any violations on their property.
Q: Is a property owner or tenant responsible for mowing the alley?
A: Yes. Each property owner or tenant is responsible for keeping the alley cleaned and mowed to the midpoint of the alley.
Q: Is there an ordinance prohibiting the parking of vehicles in a backyard?
A: No. However, vehicles parked in the driveway, front yard, side yard, and backyard must not fit the definition of a “Inoperable Vehicle” which is:
- A. Is partially dismantled or wrecked; or,
- B. Cannot safely and legally be operated on the public streets and highways.
If the vehicle meets any of the above criteria, it is considered an “inoperable vehicle” and is in violation of City Ordinance.
Q: Is there an ordinance requiring the removal of dead trees?
A: No. There is no ordinance requiring the removal of dead trees - only the removal of tree limbs that are on the ground.

Q: Who is responsible for the trees that are growing between the curb and sidewalk in front of my house?
A: The property owner/renter/lessee would be responsible for ensuring the tree limbs do not obstruct pedestrian use of sidewalks or traffic.
